Punitive Damages
Dr. Brookshire developed a model in 2003 for helping triers of fact assess the appropriate amount of punitive damages. The model was first discussed in a paper at the American Economic Association meetings in 2004, first published in the Journal of Legal Economics in 2004 and is the subject of a Barrett and Brookshire chapter in the 2007 book on personal injury and wrongful death damages tri-edited by Dr. Brookshire. Barrett and Brookshire have worked for plaintiff and defense attorneys on cases involving punitive claims.
